JAMMU, Apr 11: Principal Sessions Judge Udhampur Y P Bourney today awarded 10 years rigorous imprisonment and fine of Rs 25000 to Mangal Kumar, son of Kapoor Chand of Majalta in Udhampur district for rape with a minor girl.
After hearing Public Prosecutor Koshal Kotwal and counsel for the accused, the court observed, “the prosecution has successfully proved the charges against the accused beyond any doubt”, adding “the victim was a minor girl of 15 years who was kidnapped by the accused and committed rape upon her. Rape is not just a physical condition but a crime which completely demolishes or destroys the victim and her family”.
“The mitigating factors are that convict in the instant case is a school dropout having discontinuing his studies at the 7th standard and belongs to the poor strata of the society who is in his early twenties and he had just the age of majority at the time of occurrence. He is also a first offender having no past criminal record and has shown remorse for whatever happened and has attributed”, the court said.
Taking all the relevant facts and circumstances into the consideration and also keeping in mind the aggravating and mitigating circumstances of this case, the court awarded 10 years rigorous imprisonment to the convict and imposed fine of Rs 25,000 for the commission of offence under Section 376 RPC.
He shall further undergo rigorous imprisonment for three years and pay a fine of Rs 10,000 for the commission of offence under Section 363 RPC. Both the sentences shall run concurrently, the court said, adding “out of the fine amount, if realized Rs 25,000 shall be paid to the victim as compensation. In default of payment of fine, the convict shall further undergo rigorous imprisonment for one year”.
