10 years RI awarded to Punjab based narco smuggler

JAMMU, June 17: Principal Sessions Judge Udhampur Haq Nawaz Zargar today awarded 10 years rigorous imprisonment and imposed fine of Rs 1 lakh on a narco smuggler namely Daljeet Singh, son of Kashmir Singh of Punjab from whom 65 kilogram poppy straw was recovered.
After hearing Public Prosecutor Koshal Kotwal appearing for the Police, Principal Sessions Judge Udhampur observed, “the evidence led by the prosecution is clear, cogent and consistent and has withstood the legal scrutiny and moreover, accused has also not been able to extract anything from the prosecution witnesses to brought anything on record which could have the effect of undermining their credibility that squarely meets the requirements of the ingredients of offence as defined u/s 8/15NDPS Act for which he has been charged”.
“So, having considered the aggravating and mitigating circumstances, the accused is therefore, convicted accordingly for the commission of offences. Court is of the considered view that a sentence of rigorous imprisonment for 10 years would meet the ends of justice”, the Principal Sessions Judge said, adding “in the circumstances, the convict, namely Daljeet Singh son of Kashmir Singh resident of Kapurthala, Sunder Nagar Tehsil Kapurthala, Punjab is sentenced to undergo rigorous imprisonment for ten years and to pay a fine of Rs. 1.00 lakh for commission of offence under sections 8/15 NDPS Act”.
“In case of failure of convict to pay the fine, he shall further undergo rigorous imprisonment for one year. The period of imprisonment already undergone during investigation/trial shall be set off from the period of sentence”, the court ordered.
