JAMMU, Feb 2: Principal Sessions Judge Kathua Sanjeev Gupta today awarded rigorous life imprisonment and fine of Rs 20,000 to Joginder Kumar, son of Chuni Lal of Billawar for killing his real nephew over property dispute.
While awarding conviction, court ordered that State should be burdened to provide monetary assistance to the family of victim out of its own funds because it is the protector of life and property of its citizens.
“A compensation of Rs 2 lakh will be just and reasonable for providing financial assistance to the family of victim, which shall be paid within one month by the Member Secretary State Legal Services Authority”, the court said.
“There is no doubt that convict had committed the murder of an innocent child but as per evidence on record, it appears that the provocation to commit the murder was on account of his enmity with the father of deceased over some land”, the court observed, adding “after taking into consideration aggravating and mitigating circumstances besides long incarceration of about five years of the convict this case does not fall in the category of rarest of the rare”.
