JAMMU, July 23: Chief Judicial Magistrate (CJM), Jammu, has convicted Mahajan & Mahajan Medical Agency in a case filed by the State Drugs Inspector over the sale of a drug declared Not of Standard Quality by the Government Analyst.
The accused were penalized under Section 18(a) read with Section 27(d) of the Drugs and Cosmetics Act, 1940, with a fine of Rs 80,000 and imprisonment till the rising of the court.
In a similar case, the CJM Poonch convicted M/s Affine Formulations, Tehsil Nalagarh, District Solan (HP), and three of its representatives in a case filed by the Drug Control Officer, District Poonch. The court imposed a fine of Rs 60,000 along with imprisonment till the court rose.
These convictions followed due process under the Drugs & Cosmetics Act, wherein statutory samples were collected and analyzed by Government Drug Testing Laboratories. The samples were found to have discrepancies in identity, purity, and strength.
State Drugs Controller, J&K, Lotika Khajuria, called on all stakeholders in the pharmaceutical supply chain to strictly adhere to regulatory norms to ensure the quality and safety of medicines available to the public.
