Settlement of outstanding amount imperative to get NOC on retirement: HC

JAMMU, Feb 4: A person retiring from the service cannot expect issuance of No Objection Certificate (NOC) in his favour until matter relating to the recovery of the amount outstanding against him is settled.
This was held by State High Court while disposing of a petition filed by Charanjeet Singh, who retired as Head Assistant from Tawi Bridge-cum-Medical College Division of Public Works Department on August 31, 2012.
Before the retirement of the petitioner, the Executive Engineer, PWD Construction Division No. III, sent a communication No. 6255-58 dated 19.06.2012 to the Superintending Engineer, PWD (R&B), Jammu-Kathua Circle informing him inter alia that an amount of Rs 4, 72,986 was lying against the petitioner as ‘Misc. Public Work Advance”.
The Superintending Engineer sent a copy of this communication to the petitioner requesting him to remit the amount of Rs 4, 72,986 outstanding against him as miscellaneous advance. However, there was no compliance from the petitioner, who later challenged the non-issuance of NOC.
While dismissing the petition, Justice Janak Raj Kotwal said, “a person cannot expect issuance of NOC in his favour until matter relating to recovery of the amount outstanding against him is settled”.
