UDHAMPUR, June 30: Principal District & Sessions Judge Udhampur, R.S.Jain, today acquitted accused Sudesh Kumar from charges for committing rape u/s 376 RPC after hearing C.P.O for the State and the counsel Nonu S. Khera Advocate for the accused.
The allegation against the accused was that he came to Raun Domail Udhampur in the year 2008 for appearing in BSF recruitment and stayed near the house of the complainant and trapped the complainant into his false love, raped her on the pretext of marriage and assured her that he would marry her whenever he would be selected in the belt forces.
The relation continued for six years after which the accused married some other girl from his own caste. The complainant after which lodged FIR and the accused was arrested and challan was filed by the police before the court.
The prosecution examined all the witnesses in the court during the trial and during cross examination their statements were found un-reliable and not trustworthy including the complainant. The Sessions Judge after considering all the material on record and hearing Nonu S. Khera Advocate and Deepak Singh Balouria Advocate for the accused held that it usually happens in such cases when two young persons are madly in love, they make promise several times to get married whatsoever obstacles may come in their way and in such circumstances the promise looses all its significance particularly when they are overcome with the emotions and passion and find themselves in a situation and circumstances where they are in a weak moment, succumb to the temptation of having sexual relationship and this is what appears to have happened in this case and the prosecutrix willingly consented to having sexual intercourse with the accused with whom she was in love, not because he promised to marry her but because she also desired it. Besides this lot of contradictions in the statements of the witnesses including the complainant and un-explained delay in lodging of FIR was also cited by the counsel of the accused.
