SC upholds Bedi Comm findings

Jammu, Apr 8: Supreme Court has upheld the findings of the Justice (retd) H S Bedi Commission, which had absolved the National Conference working president, Omar Abdullah of any involvement in the much-publicized death of National Conference activist Syed Mohammad Yousaf Shah alias Haji Yousaf.
Dismissing the petition demanding CBI probe into the incident, the Division Bench comprising Justice Ranjan Gogoi and Justice Mohan M Shantanagoudar said, “in view of the post-mortem report dated October 11, 2011 submitted by the Government Medical College, Srinagar, which certifies that the cause of death of Mohammad Shah Haji was on account of Cardio Respiratory Arrest and also the report submitted by Justice (Retd.) H S Bedi, Commissioner of Inquiry, we don’t consider it necessary to continue to entertain this writ petition any further”.
It is pertinent to mention that on December 22, 2012 Bedi Commission in its final report had given a clean chit to then Chief Minister Omar Abdullah, and concluded that National Conference worker, Syed Mohammad Yousuf, had died due to cardiac arrest. However, two officials of Crime Branch were found guilty of failing to discharge their duties as they did not inform the family of the deceased about his arrest.
The Commission had been appointed by the State Government vide Notification SRO 340 dated 18th November, 2011 after the opposition parties trained guns at then Chief Minister Omar Abdullah over Syed Yousuf’s death and accused him (Omar) of being involved in it. The Commission in its report, however, had ruled out any foul play and had exonerated the former Chief Minister Omar Abdullah.
