SC refuses to entertain complaint against Justice Swatanter Kumar

NEW DELHI, Jan 11:
The Supreme Court has refused to entertain the complaint filed by a law intern against another retired SC judge, Justice Swatanter Kumar alleging sexual harassment.
Keeping in view the resolution of the full court that in future no complaints against any retired SC judge shall be entertained, the apex court has declined to entertain the complaint and has told that she should take steps available to her in law.
The complainant can now file a police complaint against the ex SC Justice, who is at present the Chairman of National Green Tribunals (NGT).
Justice Kumar was a sitting judge of the SC when the incident took place in May-June 2011 and the intern resigned from the internship due to the objectionable sexual conduct by the judge. In her complaint made to Chief Justice of India P Sathashivam, she has narrated three incidents of sexual harassment by the judge.
According to her, the judge put his arms on the lower portion of her back and also kissed her on the shoulder after which she was badly scared and disturbed and decided to give up internship immediately.
Justice AK Ganguly, who had to resign from the post of West Bengal Human Rights Commission chairman was not the sitting judge at the time of incident and the girl was never on the SC rolls, that is she was never the official intern while in the case of Justice Kumar, he was a sitting judge and she was his intern officially.
