SAC dismisses application of MLA Langate for probe into his assets

JAMMU, Feb 16: State Accountability Commission has rejected the request of independent MLA from Langate Engineer Abdul Rasheed to investigate into his assets in the wake of allegations against him of having amassed disproportionate assets at various places.
The MLA had filed an application before the Commission seeking investigation into his assets in rebuttal to the allegations made against him and to obtain clean chit from the Commission.
The  Full Commission headed  by Chairperson Justice B A Khan and Members Justice J P Singh and Justice Bashir A Kirmani, which met few days back, considered the case of MLA and turned down his request for want of jurisdiction.
The SAC has dismissed the application on the ground that it had no jurisdiction to investigate or enquire into the assets of any “Public Functionary” unless a complaint was made in that regard under Section 11 of the Jammu and Kashmir Accountability Commission Act.
“The application ex facie is not maintainable for the reason of not   being   covered   under   Section 11 of Jammu   and   Kashmir Accountability Commission Act whereof complaints against ‘Public Functionaries’ as defined in Section 2(16) can be made by ‘any person’ or the ‘person aggrieved’ which obviously would not include the Public Functionary himself”, the Full Commission said.
