Promote petitioners as Deputy Conservator of Forest: CAT

JAMMU, July 21: A Bench of Central Administrative Tribunal (CAT) comprising Rajinder Singh Dogra and Ram Mohan Johri has issued directions for promotion of petitioners as Deputy Conservator of Forest.
The order has been passed in a petition filed by three persons seeking directions to promote them as Deputy Conservator of Forest retrospectively with all the consequential benefits.
Advocate Aditya Sharma appearing on behalf of the applicants submitted that the case of the petitioners was securely covered by the Clause ll of the J&K Forest Recruitment Rules, wherein it has been categorically provided that those who had served as Rangers not less than 16 years are to be promoted from in service Assistant Conservator of Forest.
It was further submitted that the applicants were due to be promoted as Deputy Conservator of Forest with effect from 01.12.2008, 01.06.2008 and 01.04.2008 respectively but the respondents have deliberately and intentionally rejected their case on the ground that they must serve six years as AIF then only could have been considered.
The CAT observed, “when the applicants were retired they were Assistant Conservator of Forest and they were entitled to the next higher post of Deputy Conservator of Forest as per Clause ll of the J&K Forest Recruitment Rules”.
Allowing the petition, the CAT directed the respondents to promote the applicants to the post of Deputy Conservator of Forest with effect from 01.12.2008, 01.06.2008 and 01.04.2008 respectively with all the consequential benefits including the pensionary benefits and the entire exercise must be completed by the respondents within a period of three months from the date of service of this order.
