As part of the campaign and as per the directions of authorities of JKPCC and Traffic Police, surprise inspections were carried out at key locations including Bikram Chowk, Narwal, and the Sidhra Highway. HC sets aside conviction in rape case

Excelsior Correspondent

JAMMU, Apr 24: The High Court of Jammu & Kashmir and Ladakh has set aside the conviction of a man in a rape case, observing that the matter appeared to be a consensual relationship that was later given a criminal colour due to familial opposition.
Justice Sanjay Dhar, while allowing the appeal, quashed the judgment of the Fast Track Court, Kulgam, which had convicted the accused under Section 376 RPC and sentenced him to eight years’ imprisonment.
The case originated from a 2018 FIR lodged at Police Station Yaripora alleging kidnapping and sexual assault. However, during trial and appellate scrutiny, it emerged that the prosecutrix had accompanied the accused out of her own free will and had developed physical relations with him consensually.
A crucial aspect of the case was the age of the prosecutrix. The High Court held that the prosecution failed to conclusively prove that she was below 18 years at the time of the incident. The High Court found that the school certificate relied upon by the trial court lacked evidentiary value, as the basis of the recorded date of birth was not established, and even family members could not confirm her exact age.
The High Court observed that in the absence of reliable proof of minority, the offence of statutory rape could not be sustained, particularly when the prosecutrix herself admitted that the relationship was voluntary.
Noting that the facts pointed towards a love affair between two young persons, the High Court remarked that such relationships are often turned into criminal cases due to social and familial pressures.
The High Court also referred to recent judicial observations cautioning against misuse of stringent laws in cases involving consensual relationships among adolescents, emphasizing the need for courts to carefully assess context and evidence.
Setting aside the conviction and sentence, the High Court ordered the immediate release of the appellant, if not required in any other case, thereby bringing an end to the criminal proceedings.

Swami Ram Swarup highlights Vedic teachings on oneness of God

Excelsior Correspondent

JAMMU, April 24: A spiritual discourse on the essence of Vedic wisdom marked the ongoing 78-day Yajna at Ved Mandir in Yol (Kangra, Himachal Pradesh), where noted scholar Swami Ram Swarup, Yogacharya, expounded on the fundamental principles of creation, the oneness of God, and the divine laws governing the universe.
Addressing a gathering of devotees, Swami Ram Swarup referred to Atharvaveda mantra to underline that the Supreme Being is one and indivisible, beyond all numerical distinctions. He reiterated Vedic expressions such as “Sa eva eka” and “Eka eva,” affirming that God alone exists as the absolute and eternal reality.
Elaborating further, he explained that all components of creation, including the Sun, Moon, and Earth, exist within the Supreme Being and function strictly according to divine laws. These non-living elements, he said, operate under the omnipresent power of God, who sustains the entire cosmos.
Citing Rigveda mantras, Swamiji noted that the knowledge of creation-covering time, day, and night-originates from eternal Vedic wisdom revealed to four ‘Rishis’ at the beginning of creation. Referring to Rigveda, he described God as the “Sun of Suns,” the ultimate source of all light and energy, including the creation of the sun itself.
He emphasized that natural processes such as rainfall, electricity, and the functioning of the universe are governed by divine intelligence. Quoting Rigveda, he stated that a true understanding of creation is possible only through Vedic revelation and its study.
Drawing from the Shrimad Bhagavad Gita, Swami Ji cited ‘Shlokas’ to explain the cycle sustaining life, wherein beings depend on food, food on rain, and rain on yajna, which is ordained by the Supreme Being.
Concluding his discourse, Swami Ram Swarup Ji stressed that true knowledge of God and creation can only be attained through Vedic wisdom imparted by sages. He also invoked the teachings of Guru Nanak, stating that without realization of God, human beings continue to experience suffering shaped by their karmas.
