JAMMU, May 23: Chief Judicial Magistrate (CJM) Jammu Preet Simran Kour Grover today awarded one year imprisonment and imposed fine of Rs 10000 on Gourab Sharma, son of Puran Chand of Jawahar Nagar New Plot Jammu, a Matador driver for causing death of Kashish Vaid on October 3, 2010 due to rash and negligent driving.
After hearing APP Vikram Parihar for the UT whereas Advocate Anil Biloria for the accused, the CJM observed, “bearing in mind the galloping trend in road accidents in India and the devastating consequences visiting the victims and their families, criminal courts cannot treat the nature of the offence under Section 304-A RPC as attracting the benevolent provisions of Section 4 of the Probation of Offenders Act”.
“Therefore, accused is sentenced to undergo simple imprisonment for one month with fine of Rs 1000 for commission of offence under Section 279 RPC as well as simple imprisonment for one year along fine of Rs 10,000 for commission of offence under Section 304-A RPC. All these punishments shall run concurrently”, the court said.
