NIA court relaxes travel curbs on MLA Para

JAMMU, Dec 9: Special Judge NIA Jammu Prem Sagar has modified a key bail condition of Pulwama MLA Waheed ur-Rehman Para, allowing him to travel outside the Union Territory of Jammu & Kashmir and move within the country after intimating his location and purpose of visit.
Para, an alleged accused in RC No. 01/2020/NIA/JMU in the case titled NIA Versus Syed Naved Mushtaq & Others had moved an application seeking relaxation of the first condition imposed while granting him bail on January 9, 2021. The earlier condition barred him from leaving the UT without prior written permission of the trial court. He argued that after being declared an MLA in the Assembly elections, he was required to discharge constitutional duties that may necessitate travel outside J&K.
The applicant also submitted that his passport already stands surrendered, reducing any apprehension of flight risk, and undertook to comply with all other bail conditions.
The NIA opposed the plea. CIO NIA DySP Pankaj Aggarwal filed objections stating that the application was not maintainable and expressing apprehension that the accused could misuse the liberty and may not return to face proceedings in the chargesheeted case. The agency sought dismissal of the application.
After hearing Advocate Alok Bambroo for the applicant, and SPP K S Pathania for the NIA, the court noted that the High Court of J&K and Ladakh had already relaxed a similar condition pertaining to Para through an order dated November 28, 2025. Considering parity, the trial court modified the earlier restriction.
“He shall not leave the UT of J&K without prior written permission of this court during the period of bail” was thus modified to allow him to travel across the country after intimating his location and purpose of visit, the order said.
