MLAs’ nomination case: DB grants 4 weeks to petitioner to file rejoinder

JAMMU, Aug 14: The High Court of Jammu & Kashmir and Ladakh has granted the petitioner four weeks’ time to file a rejoinder in a case challenging the Lieutenant Governor’s powers to nominate members to the Union Territory’s Legislative Assembly.
A Division Bench comprising Justice Sanjeev Kumar and Justice Rajesh Sekhri noted that the reply on behalf of the Union of India has been filed. On the request of the petitioner’s counsel, the court allowed four weeks to file a rejoinder affidavit, if any, and listed the case for September 26 cautioning that no further adjournments will be granted for pleadings.
The PIL, moved by Ravinder Kumar Sharma, Senior Vice President and Chief Spokesperson of the J&K Pradesh Congress Committee, challenges Sections 15, 15A and 15B of the J&K Reorganization Act, 2019. These provisions empower the LG to nominate two women, two representatives from the Kashmiri Migrant community (including one woman), and one member from the displaced persons of Pakistan-occupied Jammu & Kashmir (PoJK).
