JAMMU, Jan 30: Principal Sessions Judge Samba, Kartar Singh today awarded life-imprisonment to man, who committed murder of his friend over a triffle issue.
According to the police case, on February 3, 2009 the accused namely Ramesh Singh alias Bhollu, son of Tribat Singh of Banam, Samba inflicted grievous injuries on the head of his frient Omkar Singh, son of Balwant Singh of Kard, Samba leading to latter’s death on the spot.
After hearing both the sides, Principal Sessions Judge observed, “it is true that Section 302 RPC mandates that whoever commits murder shall be punished with death or imprisonment for life and shall also be liable to fine. The only consideration in this case is whether the accused should be awarded capital punishment or imprisonment for life”.
“The life imprisonment is a rule and death penalty is an exception and should be awarded in the rarest of rare cases. Taking into consideration the circumstances under which the crime has been committed, it is found that it is not a rarest of rare case and it is a fit case where the accused deserves only life imprisonment”, the Court said.
Accordingly, the court awarded rigorous imprisonment for life to the accused along with fine of Rs 5000.
