UDHAMPUR, Oct 20: The Court of Principal Sessions Judge Udhampur today sentenced a 41-year-old man to 20 years of rigorous imprisonment for sexually assaulting a minor girl.
The convict, Mohammad Arshad alias Nika of Bain, presently residing at Motor Shed Chenani, was found guilty under Section 5(m) of the POCSO Act and fined Rs 50,000.
The Court ordered that the fine, if recovered, be given to the victim for her medical and rehabilitation expenses.
The case dates back to July 2020, when the victim’s mother lodged a complaint at Police Station Ramnagar alleging that the accused assaulted her daughter while she was plucking pears.
The investigation conducted by then SHO Ramnagar, Inspector Jaswinder Singh, later confirmed aggravated sexual assault, leading to additional charges under IPC and POCSO sections.
During the trial, the victim’s testimony and medical evidence proved the offence beyond doubt.
While the prosecution demanded the maximum punishment, the defence sought leniency.
Principal Sessions Judge Udhampur Virinder Singh Bhou observed that the act was heinous and traumatising but did not warrant life imprisonment.
He awarded 20 years of rigorous imprisonment and directed the J&K Legal Services Authority to grant compensation to the victim.
Accordingly, the convict was lodged in District Jail Udhampur and informed of his right to appeal.
