Bandipora, Aug 4: A court today convicted three men and awarded them life imprisonment for beheading their neighbour and business associate.
Principal Sessions Judge Bandipora, Muhammad Ali Khan, awarded lifer to Ali Ghulam Waloo, Hassan Waloo and Sikender Waloo residents of Nowgam Sumbal for murdering one Nissar Ahmed Shama of same village.
All the three accused harbored vengeance against Shama and had beheaded him in their house and dumped the body in nearby field in year 2006.
In its 60-page Judgment, the court awarded life sentence to three persons and slapped a fine of Rs 15, 000 each.
It was alleged that the accused were owing Rs 98, 000, to the deceased and the trio were harassing him with the intension to usurp the money. They eliminated Shama on 12-0-2006 by beheading him inside the house with a sword and dumping his body in fields.
Police had filed an FIR 153 of 2006 u/s 302, 34 RPC and after carrying out investigation charge sheet was filed in the court on 10-10-2006.Various articles including stained clothes, spade, sword and dairy were recovered near the spot of incident.
The court after hearing the arguments of the public prosecutor, Advocate Hafeez Ahmed Lone found all the accused culpable of murder and awarded them life imprisonment.
Taking into consideration, the evidence and eye-witness account of the occurrence supported by corroborative evidence, the Court held that the prosecution has proved beyond doubt that the accused intentionally killed Nissar Ahmed Shama.
“I am of the considered opinion that the case of the accused/convict is not the rarest of the rare case where the convicts should forfeit his right to life because no case for awarding capital punishment is made out,” the Principal Sessions Judge Muhammad Ali Khan held.
The Court, however, awarded life imprisonment to all the three accused and imposed a fine of Rs 15,000 to each, and in case of default of the fine, the convict has to undergo a further imprisonment of three months.
