JAMMU, Jan 31: In a dowry death case, Additional Sessions Judge Udhampur, M K Sharma today awarded life-imprisonment to husband, sister-in-law and mother-in-law of the deceased.
According to the police case, ever since deceased Rajni Gupta’s marriage with Sunny Gupta she was being harassed for want of dowry. On March 9, 2009, Rajni Gupta was found dead in the house of her in-laws and post-mortem revealed that there was poison in the stomach of the deceased. Accordingly, case under Section 302 RPC was registered and on conclusion of investigation challan was presented in the court of law.
After hearing APP Tariq Mujahid Mughal for the State whereas Advocate P K Jandial for the accused persons, Additional Sessions Judge, M K Sharma observed, “there is nothing so uncommon about this crime to deem it as exceptional case in which instead of life imprisonment, death sentence could be awarded”.
“Though a young bride has lost life in the instant case but it does not fall in the category of rarest of rear cases where the death sentence is warranted. The convicts—Sunny Gupta, husband of the deceased, Rupali Gupta, sister-in-law and Kanta Gupta, mother-in-law, are therefore sentenced to imprisonment for life and fine of Rs 5,000 each for the commission of offence under Section 302 RPC and imprisonment for 3 years and fine of Rs 2000 each for the commission of offence under Section 201 RPC”, the Court said.
