JAMMU, Aug 25: 2nd Additional Sessions Judge Jammu Pawan Dev Kotwal today awarded life-imprisonment and fine of Rs 5000 to Sunil Kumar, son of Bodh Raj of R S Pura in a murder case.
After hearing APP KA Qazi for the State, the court observed, “though the accused is proved to have killed the deceased with intention or at least knowledge that the injury caused by him to the deceased was likely to cause death”.
“But admittedly, no enmity between the accused and deceased prior to the day of occurrence is proved and therefore, in the given circumstances, the offence does not fall in the category of rarest of rare”, the court said, adding “otherwise, also, the age of the accused— 35 years and his conduct during the trial are the mitigating circumstances in his favour warranting the alternative sentence only—lesser sentence”.
Accordingly, court awarded rigorous imprisonment for life and fine of Rs 5000.
