Life-imprisonment awarded in murder case

KULGAM, Jan 30: Principal Sessions Judge Kulgam Kishore Kumar today awarded life imprisonment to Mohammad Asif Bhat, son of Javid Ahmad Bhat of Kulgam, who was involved in murder case.
After hearing Public Prosecutor for the State whereas Advocate Tahir Bhat for the accused, court observed that heinous and gravity of the offence as committed by the accused in the present case would be sufficiently avenged by imposing alternative sentence of ‘transportation of life’.
“It is settled principle of law that imprisonment for life and fine is a rule and death penalty is an exception for commission of offence of murder punishable under Section 302 RPC”, the court said, adding “the mitigating facts of the case are that there is no previous conviction against the accused person and this case does not fall in the category of rarest of the rare cases”.
“Life term would commensurate with the level of the guilt and gravity of offence proved against the accused person and accordingly accused is awarded the rigorous imprisonment for life which means till his natural death”, the court ordered.
