SRINAGAR, Feb 29: Additional Sessions Judge Anantnag Khalil Ahmad Choudhary today awarded life-imprisonment to Nasir Ahmad Sheikh, son of Bashir Ahmad Sheikh of Bijbehara, who had committed the murder of a teenager.
According to the police case, Nasir Ahmad Sheikh had committed the murder of Iqra Nisar, daughter of Nisar Ahmad Khan of Bijbehara on January 30, 2014 and accordingly case under Section 302 RPC was registered.
After hearing both the sides, the Additional Sessions Judge Anantnag convicted the accused and observed, “the convict has committed a very serious crime so he deserves severe punishment which would be proportionate to the crime committed by him. However, the convict has submitted that he deserves a lenient view in so far as the quantum of sentence is concerned because he is a young man and is languishing in jail since 2014”.
“It is true that innocent life has been lost and convict is squarely responsible for the death of the deceased but there are certain norms which govern the imposition of sentence”, the court said, adding “protection of society and stamping out criminal proclivity is the object of law, which must be achieved by imposing appropriate sentence”.
The court further observed, “the facts and the evidence do not suggest that it was a diabolical murder. Murder by itself is a serious crime but the manner in which it was committed and the motive behind the murder do indicate that it would not fall within the rare category of the cases”.
“The convict does not have any previous criminal record so keeping in view his age, the manner in which the murder was committed by him and all other factors, I am of the view that he does not deserve the extreme penalty of death. So taking all the factors in view, accused while being convicted under Section 302/ RPC is sentenced to simple imprisonment for life and fine of Rs one lakh for commission of the offence under Section 302/ RPC”, the Judge said.
