SRINAGAR Apr 7: A day after Government directed removal of milk products, being manufactured by the M/s Khyber Agro Farms Private Limited, from the market, the company today suspended its operations but has challenged the local court order.
Khyber that distributes around 50, 000 litres of milk and over 2000 kilogrammes of curd in the market daily, today suspended its operation following Government order.
However, the company challenged the order of Sub-Judge Budgam, Imtiaz Ahmad Lone, in Sessions Court Budgam. Lone in his judgment had said: “The Commissioner Food and Safety shall immediately take all steps in ensuring that the convicted company is closed or products are taken off from the market unless Referral Laboratory Kolkata declares that the products of the convicted company as safe to consume and products manufactured by the convicted company do not harm the nation as is proved by the medical report submitted by the SKIMS.”
While arguing the case before Sessions Judge Budgam, senior Advocate of Jammu and Kashmir High Court, Zafar Ahmad Shah, today said that the judgment of the Sub-Judge is bad in law and can’t sustain in the eyes of law.
Advocate Javed Mohammad Hubbi, representing the Food Safety Department, sought time for his arguments and the case was listed for Saturday.
In the meantime, District Bar Association Budgam today prayed before the Sessions Judge Budgam that as consumers of the Khyber Milk products they should be given an opportunity to plead the case on behalf of general public.
