Judicial Academy organizes refresher course for Munsiffs

JAMMU, Apr 5: Under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of (Judges, State Judicial Academy Justice Muzaffar Hussain Attar, Chairman and Justice Hasnain Massodi, Member), Jammu and Kashmir State Judicial Academy today conducted one day refresher course for Munsiffs of Jammu province on Code of Civil Procedure and Evidence Act at Judicial Academy.
Justice (Retd.) O.P. Sharma was the resource person. The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy. In his introductory remarks, Director, State Judicial Academy deliberated on the need for such refresher programmes for the Judicial Officers.
Justice Sharma dealt with 1st and 2nd topics of the programme. He exhaustively explained the provisions of Sections 42, 52 to 56 of Specific Relief Act i.e. Discretion of court as to declaration of status or right, preventive relief how granted, temporary and perpetual injunctions, Gift both under Hindu Law and Muslim law and Lease u/s 105, 106 and 107 of Transfer of Property Act.
3rd and last session was dealt by Pawan Dev Kotwal, Director, State Judicial Academy who by his vast and varied experience as District and Sessions Judge made this part of programme more interesting and absorbing by dictating some court orders and legal terms.
He highlighted the importance and relevance of Urdu as court language for judicial officers in discharge of judicial functions and quoted instances when the lack of proper knowledge of urdu made impediment in the effective and expeditious disposal of cases.
The participating officers freely interacted with the Resource persons and sought clarification of several aspects of application of law and also the ways and means as to how those difficulties are to be surmounted.
