POONCH, Oct 14: Principal Sessions Judge Poonch, Tahir Khurshid Raina has convicted and sentenced the accused for outraging the modesty of woman.
According to the prosecution case, a girl who hails from Poonch while coming on vacations from Jammu boarded the vehicle of the accused named Kuldeep Raj, son of Vijay Lal of Poonch. When vehicle reached Surankote rest of the passengers got alighted and only the girl left alone in the vehicle.
The accused taking advantage of her loneliness started talking immoral and attempted immoral acts. In order to save her dignity, the jumped out of the moving vehicle which resulted in fracture on her foot. A passerby came to her rescue and brought her to her residence at Poonch.
In order to dodge the police, the accused changed the number plate of the vehicle. However, a case of attempt to rape and voluntarily causing hurt and disappearance of evidence got registered against accuse and investigation ensued. Finally, challan was presented. During the course of trial the offence of outraging the modesty of woman was established along with other offences.
After considering all the aspects of the case and hearing counsel for the accused, Principal Sessions Judge Poonch awarded six months rigorous imprisonment with fine of Rs 10,000 to accused under Section 354 RPC. He was also awarded six months rigorous imprisonment under Section 325 RPC. Both the sentences will run concurrently, the court directed.
“The fine recovered shall be paid to the victim. In case of non-payment of fine, the accused shall further undergo simple imprisonment of three months”, the court directed and observed, “in such a society where the woman’s dignity is unsafe, such society will never blossom. Unfortunately we have witnessed spate in such happenings in the present society and needs to be addressed with all seriousness”.
