Hearing on case against Parrikar adjourned till Aug 29

PANAJI:Hearing of the cheating case filed by advocate Aires Rodrigues against former Chief Minister Manohar Parrikar and Nilesh Amonker, Managing Partner of Apex Computer and Engineering Services has been adjourned to August 29, by Panaji Chief Judicial Magistrate Ashley Noronha.
Adv Saresh Lotlikar, whom the government has appointed as Special Public Prosecutor, was absent yesterday.
In a complaint filed on February 6 at the Panaji Police Station Mr Rodrigues had alleged that Manohar Parrikar and Nilesh Amonkar had committed offences under Sections 420, 406, 409 read with Section 120-B of the Indian Penal Code by having criminally conspired, cheated and caused loss to the State exchequer in the fraudulent renting of office premises at Spaces and Kamat Towers at Patto Plaza at a very exorbitant annual rent of over Rs 5.5 crore.
With the Panaji Police failing to act, Mr Rodrigues later moved the Panaji Court seeking directions to register an FIR against Manohar Parrikar and Nilesh Amonker and to promptly investigate the case while also seeking that the Court monitor the investigation as the accused Manohar Parrikar and Nilesh Amonkar are politically well connected.
In his petition filed under Section 156(3) of the Criminal Procedure Code, Mr Rodrigues alleged that the Panaji Police were acting as caged parrots in shielding the politically very influential accused Manohar Parrikar and Nilesh Amonker. The lawyer in his petition urged that the police be directed to promptly investigate the case that the Court monitor the investigation as the accused Manohar Parrikar and Nilesh Amonkar were politically well connected.
Mr Rodrigues had in his petition drawn the Court?s attention that Mr Parrikar by a note moved on November 26, 2012, had directed that readymade premises of around 3000 sq. mts be hired to accommodate government offices but on February 25, 2013, an altered and tailor made advertisement was issued calling for Expression of Interest for office space of 6000 to 7000 sq mts on Hire Purchase basis for which besides Nilesh Amonker the only other valid bid was Prudential Group Real Estate Developers owned by Nilesh Amonker?s brother-in-law Gaurang Sinai Suctancar.
The senior lawyer had alleged that Mr Parrikar and Mr Amonker hadhatched a conspiracy with dishonest intention for their sole benefit and that on instructions of Mr Parrikar, the Government had high-handedly deviated from Hire Purchase and surprisingly instead took Nilesh Amonker’s premises on a three year locked rental agreement extendable by another three years with a 3.5 per cent annual increase in rent.
Mr Rodrigues had stated that if the premises were not being takenon Hire Purchase as was advertised it was required to re-advertise as Government was deviating from the original advertisement. (AGENCIES)
