JAMMU, May 8: In a petition filed against alleged illegal constructions and closure of 40 feet link road from Panthal Road to Ambica Bye-Pass Road in violation of Master Plan, High Court today directed the Deputy Commissioner Reasi to constitute a committee to demarcate the land reserved for construction of proposed road.
After hearing Advocate Abhinav Sharma appearing for the petitioners whereas AAG HA Siddiqui appearing for the State, Advocate Adarsh Sharma for the Katra Development Authority and Advocate Virender Bhat for the respondents, Justice Muzaffar Hussain Attar directed Deputy Commissioner Reasi to constitute a committee comprising of one of the senior officers of Katra Development Authority, Municipal Committee Katra, Tehsildar Katra, Executive Engineer PWD R&B and Town Planner.
“The committee should be headed by Deputy Commissioner to issue order in this behalf with in one week. Moreover, the committee should visit the spot within one week after its constitution, identify and demarcate the land reserved for construction of the proposed road from Panthal Road to Ambica Bye-Pass Road along PHE Complex”, the High Court said.
“The immovable property in Katra has assumed significance from the material point of view for some people. The respondent-State in order to maintain the beauty and ecology of Katra has prepared a Master Plan for the township. The civic laws are in operation in Katra township also. Any construction activity to be undertaken by any owner of the immovable property has to synchronize with civic laws and the Master Plan. All the authorities including Katra Development Authority and Municipal Authorities are duty bound to implement the civic laws and Master Plan”, Justice Attar said.
The High Court also directed the Deputy Commissioner Reasi to ensure that no construction activity is undertaken by any person including the petitioners and private respondents in violation of any of the civic laws or terms and conditions of the Master Plan and personally ensure that any construction to be raised will be strictly in accordance with permission granted by the competent Authority.
