HC upholds PSAs of OGWs

Srinagar, Aug 23: High Court dismissed the two pleas of Over Ground Workers (OGWs) challenging their detention orders passed under Public Safety Act (PSA) against them and upheld both PSAs passed by the detaining authority.
Justice Sanjay Dhar upheld the PSAs of Zameer Ahmad Shah of Mattan Anantnag and Mohammad Rafi Najar of Bijbehara, Anantnag. Detenue-Shah was detained on 20.05.2024 while detenue-Najar was detained on 01.04.2024.
The respondent-detaining authority while opposing both the pleas submitted before the court that the petitioner-Shah was in touch with hybrid terrorists and other over ground workers of terrorists so as to spread terror activities in the valley particularly in District Anantnag.
It has been contended that he is deeply influenced with false anti-national narrative being patronized by the handlers sitting across the border who are hell bent to destabilize security of the State as such his activities were prejudicial to security of the State and normal law of the land was not capable to deter him from his nefarious activities which prompted the detaining authority to pass the impugned order of detention on the basis of material produced before the said authority by the sponsoring authority.
In case of detenue-Najar court has been informed that he has been in touch with terrorists and over ground workers to carry out their commandments and is indulging in activities prejudicial to security of the State and is provoking the people to wage war against Government of India.
“For the foregoing reasons, I do not find any merit in these petitions. The same are dismissed, accordingly”, court said.
