SRINAGAR, Nov 14: The High Court has upheld the detention order of two Over Ground Workers (OGWs) passed under Public Safety Act (PSA) by observing that there is no ground to interfere with these PSAs.
Justice Sanjay Dhar has upheld the PSAs of Abdul Rashid Wani of Pulwama and Abdul Basit Paul of Shopian. The detention of both were ordered by the concerned District Magistrates on 12.11.2024 and 12.09.2024 respectively to prevent them from acting in any manner prejudicial to the security of the state.
Grounds of detention reveal that Wani was in liaison with the PoK handlers who are directing him to recruit the locals in the terrorist cadres and is using various VPN applications for subversive activities.
“It has been specifically alleged that the petitioner-Wani is using WhatsApp numbers which are registered in the name of his son as well as in the name of his nephew for communicating across the borders with many anti-national handlers stationed in POK/PAK, particularly Naveed Iqbal @Usman Kotwal, who is head of banned outfit Muslim Janbaz Force, Abdul Hameed Lone of Baramulla, presently in POK, Engineer Mehmood Mushtaq Mirza of Tral representing banned Peoples League from Pakistan, Mohammad Shafi Dar R/o Kupwara presently in Muzaffarabad representing Peoples League in Muzaffarabad (POK)”, reads the Grounds of detention.
The grounds of detention of Paul reveal that he is in contact with an active terrorist, namely, Shahid Ahmad Kuttay, of Chotipora, Sedow, working as an OGW for him and providing all kinds of support like transportation, food and shelter to the said terrorist.
The petitioner-Paul had developed contacts with active terrorists operating in the district like Abid Ramzan Sheikh and Shahid Ahmad Kuttay. Thus, there are specific allegations made in the grounds of detention against the petitioner-Paul and in these circumstances, it cannot be stated that the grounds of detention are vague, as has been claimed by him”, reads the judgment
“For the foregoing reasons, I do not find any ground to interfere with the impugned orders of detention. The petitions lack merit and are dismissed accordingly”, Justice Dhar concluded.
