HC stays proceedings in CB FIR

JAMMU, Oct 2: High Court has stayed the proceedings in a case registered by Crime Branch against three persons over allotment of evacuee land.
The case against Sunil Dutt, Vikram Chargotra, sons of Sukh Chain and Vikaz Ahmed, son of Bashir Ahmed was registered by the Crime Banch on September 6, 2016 under Sections 420, 465, 466, 467, 471, 120B RPC read with Section 5(2) of J&K Prevention of Corruption Act.
However, the same was challenged by these persons in the High Court on the ground that FIR was a gross abuse of the process of law as the petitioners had neither cheated anybody nor forged any document and connived with Custodian Evacuee Property, Jammu.
They submitted before the High Court that Custodian General had passed an order dated October 8, 2013 permitting Vikram Chargota to utilize the land for residential purpose and thereafter permission to utilize the land for commercial purpose also.
They said that FIR has been lodged on the failure of Wali Mohd, son of Shallan of Kote to get any relief from the authority under Evacuee Property Act.
After hearing counsel for the petitioners, Justice B S Walia stayed the proceedings in the FIR till next date before the bench and subject to filing of objections.
