JAMMU, Apr 16: In a petition filed by Joginder Pal Gupta, Physical Education Master Higher Secondary School Batote, whose rank was reduced to Physical Education Teacher, High Court issued notice to DG Youth Services and Sports, Secretary Sports Council, Director School Education, ADC Ramban, CEO Ramban, ZEO Batote and Principal Government Higher Secondary School, Batote returnable within four weeks.
In the petition, it has been submitted that in the month of January 2013 some students from Class 11th of Govt Higher Secondary School Batote lodged a complaint with the Minister of State for Technical Education that the Principal Higher Secondary School Batote was demanding illegal gratification from the students to pass them in 11th class examination and when they refused to give illegal gratification to him, he failed them.
Acting on the complaint, the Minister directed ADC Ramban to hold an enquiry in the matter. Th ADC, after conducting enquiry, gave clean chit to the Principal and all other concerned officers, who were associated with examination.
The ADC Ramban also conducted an ex-parte enquiry against the petitioner and submitted the report to the Director School Education, Jammu, who forwarded the same to DG Youth Services & Sports. The DG then issued show cause notice to the petitioner and sought explanation from him to which the petitioner replied with the submission that being Physical Education Master he had no role to play the examination of any class. However, the DG passed the demotion order of the petitioner from Physical Education Master to Physical Education Teacher.
After going through the petition and arguments of Advocate Amit P Sehgal appearing for the petitioner, Justice Tashi Rabstan stayed the demotion order subject to the objection from other side.
