Advocate Abdul Basit Bhat, a practicing advocate in district Shopian had challenged the notification issued by the Election Commission of Association on 11.12.2025 for fresh elections which were scheduled to be held on 27.12.2025.
The notification has been challenged on the ground that the amendment made in the Bar Constitution has deprived the young lawyers from participating in the elections of the Bar.
Justice Rajesh Sekhri stayed the notification of Bar elections. The court said the petitioner has made out the case for interim relief and issued notice to the respondents for reply to the plea.
“Meanwhile, impugned notification dated 11.12.2025 regarding fresh election of the Bar shall stay”, read the order.
The advocate is aggrieved of the amendment of Constitution of District Bar Association Shopian, made in the year 2023 on the grounds that amendment came to be introduced by a handful members of the Bar in the absence of amendment Clause/Article in the earlier constitution of 2012, to restrict and deprive young advocates from participating in the elections of the Bar.
It is contended that on 17.10.2025 he applied for the copy of amended constitution, the name of members who proposed the amendment, copy of notice issued to members for general body meeting, minutes of meeting of the general body with details of members who participated in the meeting, name wise list of members who voted in favour of the amendment and notice/circular of adoption of the amendment, however, said information has not been provided to the petitioner till date.
