HC seeks personal appearance of Director SWD on shelter homes

SRINAGAR, Apr 3: High Court has sought personal appearance of Director Social Welfare Department in case a detailed affidavit is not been filed by next date regarding establishing of shelter homes for destitute women across Jammu and Kashmir.
The direction has been passed by the Division Bench of Chief Justice Tashi Rabstan and Justice M A Chowdhary in a Public Interest Litigation (PIL) seeking directions for establishing shelter homes for destitute women across Jammu and Kashmir as mandated under Domestic Violence Act, 2005.
The court had on last occasion granted the Government four weeks time to file affidavit to the response filed by the petitioner to an “inadequate” response filed by authorities in the instant Public Interest Litigation filed by an organization namely Mehram Women Cell Kashmir
Last year the petitioner had filed a response to a status report submitted by the authorities in the PIL as the same was considered “inadequate” on various aspects for proper implementation of Domestic Violence Act, 2005 in terms of infrastructure, manpower etc.
When the matter came up for further consideration it was observed that the detailed affidavit in terms of order previous orders has not been filed till date.
“Faheem Nissar Shah, GA, seeks and is granted further one week’s time as final opportunity, failing which, the Director Social Welfare Department shall appear in person on the next date of hearing. List again on 16-04-2025”, DB directed.
