HC refuses to take up petition on Kunan-Poshpora mass rape case

Srinagar, May 14: High Court today refused to take up a petition on the Kunan-Poshpora alleged mass rape case, holding that it would be premature for it to intervene as the case is pending before a Sessions Court.
A Division Bench comprising Chief Justice M M Kumar and Justice Ali Mohammad Magray refused to entertain the petition filed by human rights activist Parvaiz Imroz on behalf of 50 alleged victims of the mass rape that took place in 1990.
The petitioner has appealed for re-investigation of the case and compensation for the victims.
The court observed that it would be premature for it to intervene in the case as it is pending for disposal before the Sessions Court in Kupwara.
The court, however, asked the Sessions Court to expedite the proceedings.
The State Human Rights Commission had in 2011 directed the State Government to pay compensation of Rs 2 lakh each to the victims. However, so far, no compensation has been paid.
A high level committee is discussing the recommendations of the SHRC and court hoped and trusted that recommendations are seriously debated and a decision is taken by the committee expeditiously and preferably within a period of four weeks.
The court has closed the PIL, however, petitioners can approach the court after final decision is taken on the case.
