JAMMU, May 7: State High Court today quashed the selection and appointment of a lecturer in the Surgery Department of Government Medical College, Jammu.
The judgment was delivered in a petition filed by Dr Rajiv Gupta and Dr Shyam Kumar Gupta challenging the selection and appointment of Dr Amit Suri, Lecturer Surgery Govt Medical College Jammu. The ground behind challenging the selection was that in terms of the recruitment rules a candidate is required to have a Masters Degree (MS) in General Surgery/Surgery or equivalent qualification to his credit and also two years experience as Registrar/Tutor/Demonstrator or senior resident in a recognized teaching Medical Institution recognized by Medical Council of India or the University of J&K. However, Dr Amit Suri was not possessing the requisite experience at the time of his selection.
After hearing Senior Advocates MK Bhardwaj, AH Naik, RK Gupta and Advocates DS Chouhan, Rattan Lal Gupta Ajay Abrol and Prem Sadotra for the petitioners whereas battery of lawyers for the respondents, Justice Hasnain Massodi quashed the selection and appointment of Dr Amit Suri with the direction to the PSC to reframe the merit list showing Dr Ajay Anand, Dr Shyam Kumar Gupta, Dr Vikrant Singh and Dr Rajiv Gupta in that order and make recommendation for appointment against the advertized vacancies accordingly”.
“While Dr Amit Suri is to be deleted from the select list notified vide No 09-PSC of 2010 dated August 26, 2010 because of his ineligibility for the advertised posts for Lecturer Surgery, Dr Vikrant Singh shall continue to be in select list though below Dr Shyam Kumar Gupta inasmuch as even after subtracting 54 points he would be at serial No 3 in the merit list”, the Court said.
