JAMMU, Sept 27: In a petition filed by Lotika Khajuria challenged the order bearing No.265-HMER of 2008 dated 25.3.2008 whereby the private respondent Irfana Ahmad was regularized as Assistant Controller Drugs/Assistant Drug Analyst retrospectively with effect from 30.6.2002, Justice Dhiraj Singh Thakur has held that the benefit of retrospective regularization was contrary to rules and legally impermissible.
After hearing Advocate Rahul Pant for the petitioner, Justice Thakur quahed the retrospective regularization. “As a sequel to this, the petitioner shall figure senior to the respondent in the seniority list of Assistant Controller Drugs/Assistant Drug Analyst” High Court said and directed the official respondents to frame the seniority list accordingly.
The High Court also quashed the seniority list impugned.
