HC quashes 4 PSAs, directs release of detenues

Srinagar, June 14: High Court has quashed four detention orders under Public Safety Act with the direction to the authorities to release all the detenues.
The benches of Justice V C Koul, Justice Sanjay Dhar and Justice Rahul Bharti while dealing with separate cases filed by the detenues-Irfan Ahmad Malik, Gulzar Ahmad Mantoo, Parvaiz Ahmad Matoo and Parvaiz Ahmad Dar allowed their petitions and quashed PSAs with directions upon the jail authorities to release them from the custody.
Justice Koul quashed the PSA of Mantoo who was detained by District Magistrate Shopian on April 4 last year. The court said that the record reveals that the grounds of detention are vague and ambiguous and do not refer to any date, month or year of the activities, which have been attributed to detenu and the detention in preventive custody on the basis of such vague and ambiguous grounds cannot be justified.
Justice Dhar quashed the PSA of Dar who was detained on November 22 last year by the Divisional Commissioner Kashmir. The court quashed his PSA on the ground that he has not been supplied with the whole detention record in order to enable him to make representation against his PSA.
Justice Bharti quashed the PSAs of Malik and Matoo. Malik came to be detained by District Magistrate Anantnag on May 20 last year while as Matoo was detained by District Magistrate Kulgam on November 29 last year.
The court has held the PSA of Matoo as flawed and faulty rendering the same as illegal right from its very inception and set aside the same. “Resultantly, detention orders passed by the concerned District Magistrates related to the preventive detention of the petitioners are hereby quashed”, the court directed.
