HC orders status quo on Kashmiri migrants posts

SRINAGAR, Aug 5: High Court has directed the State to maintain status quo with regard to the posts advertised under Prime Minister’s Special Package for Kashmiri migrants.
The process of making recruitment for the posts identified under PM’s Special Package was initiated by the Services Selection Recruitment Board by issuing advertisement notice No.01 of 2012 dated July 19, 2012.
The exercise was challenged by a number of petitioners seeking quashment of the advertisement on the ground that they had applied and were interviewed for clear vacancies in 2010.
On January 1, 2010, the Government issued an advertisement for unemployed Kashmiri migrant youth. The petitioners were among the other migrant youth who had applied for these posts. After evaluating qualification of the applicants and their interview, the SSRB framed the merit list of all the candidates.
After reserving some posts for candidates belonging to different categories, the selection list was submitted to the Government. However, the Government deserved the category posts as no migrant belongs to SC or ST category. Besides, out of 2120 figuring in the merit list, 762 selected candidates didn’t join their services. The deserved and the posts falling vacant due to non-joining were clubbed and re-advertised by the Government leading to challenging of the process by way of present petition.
After hearing Advocate Sumir Pandita for the petitioners and counsel for the respondents, Justice Mansoor Ahmed Mir issued notice to the respondents returnable in one week. In the meantime, the Court ordered that status quo be maintained till next date of hearing.
