HC issues notices to Com Secy, FC Revenue

JAMMU, Aug 29: State High Court today issued notices to Commissioner Secretary, Revenue Department, B A Runyal and Financial Commissioner Revenue K B Aggarwal and directed them to ensure compliance of its earlier order issued on June 2, 2012 whereby they were restrained from finalizing the process of selection of candidates for Patwar Training initiated pursuant to Notification No.20 BOPEE of 2012 dated May 9, 2012.
The High Court in its order dated June 2, 2012 had also asked the respondents to consider the case of the petitioners for deputing them for Patwar Training in the light of Cabinet Decision No.151 followed by Government Order No.259/Rev(S) of 205 dated September 27, 2005.
However, respondents flouted the orders and final list of Patwar Trainees was issued vide Government Order No.201 Rev (NG) of 2012 dated August 13, 2012 prompting the petitioners to knock the doors of High Court for initiation of contempt proceedings against the respondents for deliberately and willfully disobeying the order.
Advocate Priyesh Sharma appearing for the petitioners vice Advocate W S Nargal submitted before the High Court that respondents have acted in contravention of the earlier directions, which clearly proves beyond any shadow of doubt that the respondents have committed contempt and were liable to be punished under law.
“The respondents have also not considered the case of petitioners as on date for deputing them for Patwar Training”, Advocate Sharma further submitted.
After hearing Advocate Priyesh Sharma vice Advocate W S Nargal, Justice Hasnain Masoodi issued notices to the respondents returnable within two weeks and directed them to comply with the court order dated June 2, 2012 and report compliance of the same.
