HC issues notice to BCCI

SRINAGAR, Nov 6: Jammu and Kashmir High Court today issued notice to Board of Control for Cricket in India (BCCI) and Secretary Union Government Ministry of Sports in a case filed by J&K Cricket Association (Abdullah faction) before the court in which it seeks participation in Annual General Meeting of the BCCI.
Justice MH Attar after hearing counsel for J&K Cricket Association and counsels for Sports Ministry and BCCI issued notice to them and asked them to file their reply affidavits by or before November 23 which is the next date of hearing of the matter.
The case has been filed by J&K Cricket Association president Dr Farooq Abdullah, who is seeking relief from the court that BCCI be directed to allow his Association to participate in the upcoming Annual General Meeting of the BCCI.
The counsel appearing on behalf of Abdullah submitted before the court that the trial court at Jammu had already passed a direction in favour of petitioner Association but BCCI is not accepting them as recognized Association of JKCA.
Court said the counsel to approach the trial court in this regard as the trial court is seized of the matter “and if the direction is there you can seek additional relief from the trial court” adding “If they (BCCI) do not allow you that is the violation of court order”, observed the court during proceedings of the matter.
Court also said to the counsel that orders in force should be implemented and you (Petitioner Counsel) can file contempt against the authorities.
The two factions of JKCA (Ansari faction and Abdullah faction) claimed themselves to be the recognized Association are litigating with each other on the issue before the court of law including various trial court and High Court.
The tussle between the two factions arose when the Ansari faction held the elections of the Association in the month of July 2015 and those elections were challenged before the trial at Jammu and the trial court stayed these elections.
The last election of the Association was held on May 2014 for the period of three years under JKCA.
