HC issues bailable warrants against Principal Secy Finance

JAMMU, July 26: In a petition filed by selection grade constables of police, High Court has issued bailable warrants against Principal Secretary, Finance Department to secure his presence.
In the petition filed by Talib Hussain and other selection grade constables seeking direction to the respondents for keeping intact their pay scales, which were granted to them on the basis of their in-situ promotion and staying the recovery being made by the respondents from the salary of petitioners, the High Court had directed the respondents to look into the matter and consider the claim of the petitioners taking into account the SRO 225 of 2005.
The High Court had also directed the respondents to pass appropriate orders within a period of four months.
After hearing Advocate Hafeez-ur-Rehman appearing for the petitioners whereas Additional Advocate General Gagan Basotra for the State and Advocate Ashok Misra for the respondents, Justice J P Singh observed, “affidavit filed by Principal Secretary Finance gives the past history as to how the petitioners’ case was tossed from Finance Department to the Home Department on numerous occasions without any success. But there is no mention as to what step the Finance Secretary had taken in the matter after December 23, 2011 to comply with the directions issued by the Court”.
“Moreover, Principal Secretary, who was directed to appear in person, has opted not to appear. In view of the non-compliance of directions and omission of Secretary to appear in person, his request for exemption from personal appearance cannot be considered”, the High Court said and issued bail-able warrants for securing the presence of Principal Secretary Finance.
