HC grants 4 weeks time to State in Anara’s petition

JAMMU, July 11: In a petition filed by Anara Gupta, High Court today granted four weeks time to the State for filing response.
After hearing Advocate Rahul Pant appearing for Anara Gupta whereas Deputy AG, Z S Wattali for the State, Justice A M Magrey observed, “in the status report submitted in terms of the order dated November 23, 2012 the respondents have submitted that appearance of Anara Gupta before the SIT for seeking her consent to undergo the medical examination and photography is required”.
Advocate Rahul Pant appearing for Anara Gupta objected this and submitted that in view of direction passed by the Division Bench of this Court in PIL dated September 29, 2005, there was no scope for the investigation/authority to proceed in the matter as the Division Bench has already declared FIR 25/2004 as closed.
However, Deputy Advocate General Z S Wattali appearing for the State sought time to file response in this regard. On this, Court granted four weeks time to file response regarding the contention raised by the counsel for the petitioner with reference to the Division Bench directions. The High Court directed the Registry to list this case in the week commencing August 12, 2013.
