SRINAGAR, Feb 19: High Court has framed a rule against the Commissioner/Secretary Power Development Department (PDD) for not implementing the 10-year-old judgment and directed him to show cause as to why proceedings under contempt be not initiated against him.
Justice Sanjay Dhar passed the order in a contempt petition involving implementation of judgment of the Court passed way back in the year 2014 whereby the authorities including Commissioner/Secretary PDD were directed to consider the case of the petitioner-Bilkees Yousuf for appointment on compassionate basis within a period of six weeks from the date of the judgment.
Justice Dhar said that more than a decade has passed since then but the petitioner is running from pillar to post to get the order implemented. An application has been filed by the contemnor-Kumar seeking further four weeks’ time to comply with the directions of the writ court.
“The record shows that the respondents sat over the judgment of the writ court for more than a decade and during the interregnum, the petitioner got married and thereafter, she also got divorced. Perhaps the respondents are waiting for a second marriage so that they will come with a stand that now the situation has changed and therefore the petitioner does not need a compassionate appointment”, Justice Dhar said.
On 02.12.2024, contemnor-Comm/Secy had appeared in person through Virtual Mode and assured the court that needful shall be done within a period of six weeks. But today, further time was sought on the ground that the case involves grant of relaxation in favour of the petitioner and the matter needs to be taken up with the General Administration Department.
Court said that the same ground was taken by incumbent-contemnor on last date of hearing for seeking time to comply with the judgment of the writ court while assuring this court meaning thereby that there is hardly any progress made by the respondents towards the implementation of the judgment of the writ court.
“The Registry is directed to frame ROBKAR against the respondent-Comm/Secy directing him to show cause as to why contempt of court proceedings be not initiated against him. The respondents shall appear in person before this court on next date of hearing to show cause as to why they should not be proceeded against for having violated the orders of this court”, the court directed.
