HC fixes Dec 18 for final hearing

Srinagar, Nov 21: The High Court of J&K and Ladakh today fixed December 18 for finally hearing in the much publicised Public Interest Litigation (PIL) challenging the provisions of the J&K Reorganisation Act 2019, as amended in December 2023, which authorized the Lt Governor to nominate five MLAs to the J&K Legislative Assembly,over and above the sanctioned strength.
As the matter came up before the Special Division Bench of Justice Sanjeev Kumar and Justice Rajesh Sekhri, the court wanted to know whether the parties are ready for final hearing. Upon this, the Senior Supreme Court Lawyer Prashanto Sen appearing for the petitioner requested for a short adjournment, assuring the court to finally argue on the next date.
The Bench agreed to fix December 18 for final hearing, while observing that hearing in the matter has already got delayed due to one reason or the other. The Counsel assured the bench to argue on next date.
The PIL challenging the provisions of nominations of five MLAs to the J&K Legislative Assembly was challenged by Former MLC and Chief Spokesperson JKPCC Ravinder Sharma ,a lawyer himself, in October last year, first before Supreme Court and thereafter in the J&K High Court. The HC upon preliminary hearing on Oct 21st ,had framed an important question of law and asked the Government of India & Lt Governor to file response,to finally hear the matter at length being the matter of public importance.
