Srinagar, Jan 27: High Court today directed the Block Development Council to allow the Sarpanch to function on his post till No Confidence Motion against him is adhered strictly in accordance with the law.
The Sarpanch Ashiq Hussain Ganie of Banghall, Devsar constituency of District Kulgam has approached the court against the No Confidence Motion moved by some Panchs against him as also the proceedings initiated there upon.
Justice M Akram Chowdhary directed the Block Development Council to observe strict adherence to the J&K Panchayat Raj Act with regard to No Confidence Motion or election of Sarpanch. Court directed till the decision is taken, the Sarpanch-Ganie be allowed to function as Sarpanch in the constituency.
Court has also sought reply in this regard from the Principal Secretary Rural Development and Panchayat Raj, Director Rural Development and Panchayat Raj, Deputy Commissioner, Kulgam, Assistant Commissioner Development Kulgam, District Panchayat Officer Kulgam Block Development Officer Kulgam and Chairperson Block Development Council Kulgam by next date of hearing in the matter.
