SRINAGAR, March 10: The High Court today directed all the trial courts in J&K not to entertain any kind of pleadings relating to National Highway so that the execution work on road widening is not affected in any manner.
The Division Bench of Justice Ali Mohammad Magrey and Justice D S Thakur expressed concern over the recent deaths on Highway directed for expediting the execution of work on road project from Banihal to Ramban and Nashri to Chenani. The court directed the Principal District Judge Ramban to speed up the disposal of cases pending before his court which are pertaining to land acquisition and compensation.
Court had directed the Project Director to inform the court about this issue on next date and also shall inform the court as to why the process was not initiated for acquiring the land, shifting of Towers or felling of trees before starting the project. Collector land Acquisition has also been directed to file response on issue of providing compensation to those whose land has been acquired for the project.
Deputy Commissioner Ramban has also to respond the contention of Project Director with regard to felling of trees indicating in the response as to what are the reasons for delay in felling of the trees which is one of the reasons in delaying the project.
Project Director NHAI was directed to file details of those cases which are pending in courts pertaining to the compensation of land acquired. With regard to presence of trees, court directed the Managing Director Forest Corporation to file an affidavit about felling of trees.
Chief Secretary was asked to convene a meeting with the officials of PDD, SFC and Revenue department and also associate Regional Director of NHAI as also the contractors who have been given the project in order to ensure identification of all hurdles and issues coming in between the project and solve those issues without any delay. For this purpose, court said, the CS shall appoint Revenue Secretary as Nodal officer.
“We feel CS shall ensure that all pending issues are settled without any further delay in order to speed up the project in”, court had said and also warned the executing contractors even if there is any delay on their part then court will deal with them accordingly.
