JAMMU, Mar 24: In the much publicized Samba dowry death case, High Court today rejected the bail application of one Shilpa, sister-in-law of the deceased namely Pallavi.
Justice Javed Iqbal Wani observed, “court at this stage can neither go into the evidence in such a depth which would amount to ascertaining the probability of the conviction of the accused petitioner nor can it be said at this stage that the case foisted against the petitioner is totally false”.
“The detailed examination of the evidence and elaborate documentation of the merits of the case cannot be undertaken at this stage by this court and the role of the petitioner in the commission of alleged offence is required to be left open to be investigated into by the investigating agency which is required to be given a free hand to investigate the case from all its angles”, High Court said, adding “the conduct of the petitioner and in evading of her arrest inasmuch as being wife of a police officer cannot be overlooked”.
Justice Wani further observed, “the nature of accusation and gravity of the offence also cannot be overlooked in the matter. The offence in which the petitioner is allegedly involved is punishable with imprisonment for not less than seven years which may extend to imprisonment for life”, adding “there has been a loss of life of a young budding woman in early years of her marriage otherwise than under normal circumstances by hanging”.
