HC closes PIL on welfare of transgenders

Srinagar, July 24: High Court has closed the PIL on the welfare of transgender community as the authorities informed the court that the orders of the court have been complied with and nothing survives in the petition.
The Division Bench of Chief Justice Arun Palli and Justice Rajnesh Oswal closed the PIL on welfare of transgenders after the court was informed of the steps taken by the Government on the issue.
“Various status reports/ compliance reports have been filed pursuant to the orders passed by this court. It is urged that in the wake of the affidavit furnished by the Commissioner/ Secretary, to Government, Social Welfare Department, dated March 10, 2025, nothing substantive survives in the matter”, read the order.
The counsel submitted that the proceedings in the present petitions be closed. However, if the petitioners are still aggrieved or there is any fresh cause of action, they are granted liberty to re-approach court by filing a fresh petition. “That being so, the petition is, accordingly, disposed off in terms of the statement made by the counsel for the petitioners with the liberty prayed for”, DB said.
Petitioners had approached the court for protection of constitutional rights for transgenders in both the UTs and were praying that the Government be directed to implement the judgment of Apex Court passed in a petition titled National Legal Services Authority Vs Union of India, in this connection in letter and spirit.
They in their petition submitted that the Government is duty bound to fulfill their necessities and till date it has failed to provide any concrete relief to them
