File report on removal of garbage from Badamibagh: DB to Div Com

SRINAGAR, Oct 1: Division Bench of the State High Court comprising Chief Justice Gita Mittal and Justice Rashid Ali today directed the Divisional Commissioner Kashmir to file report regarding removal of garbage from Badamibagh Cantonment area.
While hearing Public Interest Litigation regarding preservation of Sonamarg, the DB observed, “Divisional Commissioner Kashmir has not placed on record the report regarding the removal of garbage from the Badamibagh, its dumping and utilization as also the availability of dumping site as was directed on the last date of hearing”.
Accordingly, DB directed the Divisional Commissioner Kashmir to file report in this regard before next date of hearing.
DB further observed, “the status report dated August 2, 2019 filed by the Principal Secretary, Housing and Urban Development Department reveals that the Model Solid Waste Bye Laws stand published by the Government for adaption and notification by the Municipal Corporations, Councils and Committees of the State”.
The DB directed the Sonamarg Development Authority to inform the court with regard to notification of the Model Solid Waste Bye Laws. “Sonamarg Development Authority shall also inform this court about the steps taken to implement the Solid Waste Management Bye Laws and other measures”, the DB added.
On May 24, 2019, the DB was informed by Fayaz Ahmad Khan, Chief Town Planner that the process of finalizing the Request For Proposal (RFP) for revision of the Master Plan is expected to be completed within one year. “Nothing has been placed before us as to what is the status of the preparation of Master Plan Sonamarg or the re-delineation of the local area of the Sonamarg Master Plan limits”, the DB observed.
Accordingly, DB directed that the report on all the issues noted in the order dated May 24, 2019 shall be positively filed within three weeks.
