JAMMU, Oct 12: A Fast Track Court here today has acquitted a rape accused of the charges levelled against him.
As per the case a lady had complained that she was raped and deserted by the accused Ram Murti son of Terth Ram resident of Khadergal, Bari Brahmana in district Samba after solemnizing marriage with her.
On this complaint, police lodged an FIR with number 49/2014 at Police Station Bakshi Nagar Jammu for offences under sections 376/493/379/506 RPC.
Judge Khalil Choudhary, Presiding Officer at Fast Track Court after listening to arguments of both the defence and the prosecution analyzed that the evidence of prosecution and other witnesses contained contradictions which created doubt with regard to committing of rape by the accused.
The Judge also noted that the accused had admitted that the prosecutrix was his wife and she had lodged a false case against him due to domestic and matrimonial dispute.
“Therefore, on cumulative consideration of the matter in its totality there is no concrete evidence on record connecting the accused with the commission of the offence,” the Judge maintained concluding that the prosecution case has failed and the accused Ram Murti was acquitted of the charges levelled against him.
