JAMMU, Feb 19: In a petition filed by inhabitants of village Chinner seeking maintenance of Kahcharai land situated at Mouza Chinner in Ganderbal district, High Court today directed the State authorities to take action for eviction of the illegal encroachers / trespassers and restore the land for the common benefit of the villagers.
“Keeping in mind the stand taken by the official respondents besides the ratio of the judgment, this petition is disposed of by holding that the petitioners claim in so far as construction of Apna Panchayat Ghar and development of playground for common benefit of residents of the village in terms of the resolution passed by the PRI/Deh-Majlis is dismissed”, Justice Bansi Lal Bhat said.
“In so far as usurpation of the subject matter of the petition by setting up of private commercial establishments like shops and stone crushers and raising of private residential houses is concerned, the State functionaries are directed to take action for eviction of the illegal encroachers / trespassers in terms of the judgment of the Apex Court in Jagpal Singh Versus State of Punjab and restore the land for the common benefit of the villagers”, High Court said.
Justice Bhat directed that the exercise shall be done as expeditiously as possible, preferably within a period of six months. He directed Registry to send a copy of this judgment to the Chief Secretary for immediate compliance keeping in view the law laid down by the Apex Court.
